This Agreement of Terms of Service (hence forth called as Agreement) is entered between you or the organization you represent (“You”), and Skyrecs Technologies (“We”). This Agreement governs the terms of service provided under the brand name Skyrecs (hereafter referred as “Services”) offered by Skyrecs Technologies at the website www.skyrecs.com
By using Skyrecs services, you acknowledge that you have read this agreement,you understand it, and you agree to be bound by its terms. If you are entering into this agreement on behalf of a company, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions, in this case the terms "you" or "your" shall refer to its affiliates. Skyrecs is a web based solution that provides a platform to monitor records and analyze manufacturing Industry data in real time. The modules offered by Skyrecs include Production Module, Quality Module, Machine Maintenance Module and Tool Maintenance Module. Skyrecs Technologies reserves the right to add or remove additional service modules in the future.
To use these services, you need to create an account on www.skyrecs.com website. You may create, edit or remove content within your account that you are authorized to use.
You must be of legal age in order to accept the Terms of this agreement. You may accept the Terms by clicking on a checkbox indicating your acceptance of the terms. Further, you are explicitly agreeing to the terms of this Agreement once you start using the Services.
For accessing the services offered at www.skyrecs.com, you need to sign up and create a user account. During the user sign up process, you agree to provide accurate information about yourself and your organization. We will be sending account verification OTP to your email address for account verification purpose. You agree to provide a valid email address that will help in the account verification process.
Each user will be required create their separate user account for using the services at www.skyrecs.com
Skyrecs Technologies will charge you for the services that you use at www.skyrecs.com. The pricing details of these services are published at www.skyrecs.com. Once you sign up and choose to purchase any of the subscription plan, you agree to make payments using any of these modes: debit card, credit card, UPI or Internet banking. Your billing cycle starts on the day you sign up for our services. You agree to make these payments on a regular basis.
We may choose to give a free evaluation period (or trial) where you can evaluate our services. You will not be charged for the entire length of the trial period.

All Sales are final. If you choose to cancel our services at any time, you will be not be refunded the amount corresponding to time left in your billing cycle.
YYou agree to use the services in a fair manner for professional use. You shall not transfer our services to another user or third party. You shall not resell our Services to other users without prior written permission from Skyrecs Technologies. You shall not provide additional services on top of our Services without prior written permission from Skyrecs Technologies. You shall not post links to third party website without agreeing to their terms and conditions.
From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
You are solely responsible for contents that you upload, create or edit at www.skyrecs.com. You agree not to violate intellectual property rights of another user. You shall not use www.skyrecs.com for spamming or phishing activities. You shall not upload or create any material that is illegal, abusive, obscene, racist, or harmful in any way to other users of www.skyrecs.com. Skyrecs Technologies reserves the right to terminate your account and access to our services if we believe that you are using our website for any illegal activities.

We are not liable for any damage arising from theft or accidental loss of your account access information.
Skyrecs will send out regular communications about your account status and the services that you may choose. This communication will be typically delivered via email or SMS. All administrative and account related communications are compulsory and you shall not opt-out of such communications.
During the course of using our Services, you may create, upload or edit content on our website. This content will be considered as data owned by you. While you are the owner of this data, Skyrecs shall have the right to transmit, store, retrieve, archive or backup such data for efficiency and business continuity of our website.
Skyrecs offers a feature to take data backup (only of the records created) by downloading entire data at once using “Create Backup” option. You will be able to retrieve data for a maximum period of one year (i.e. if suppose today is 7 th July2019 so you can take data backup till 8th July2018). You can get up to 2 years of additional data backup on chargeable basis by sending us your request on info@skyrecs.com..
You may upload content to www.skyrecs.com that you hold copyrights for. You agree not to violate any copyrights in any form including plagiarism, posting other peoples content without written permission from them, citations without due credit to sources, uploading documents without permission from document owners, and revealing other peoples confidential information such as passwords, personal profiles and payment information. In case of violation of copyright, Skyrecs reserves the right to terminate the user account and access to services.
You understand and agree that you are using services from www.skyrecs.com at your own risk. The Services offered at www.skyrecs.com are on as-is basis. Skyrecs Technologies does not make any warranty that our services will be continuous or uninterrupted. Skyrecs Technologies disclaims warranties of any kind arising from downloading any material from www.skyrecs.com including damages to your computer or mobile phone that you use to access these Services.
You agree that Skyrecs Technologies shall not be liable for any losses or damages related to loss of business profits, interruption of business, loss of information or any other type of direct or indirect losses arising from use of our Services. Further Skyrecs Technologies shall not be liable for any losses or damages arising from prolonged non-availability of our Services due to whatever reasons. In such cases, you may choose to cancel our services. In all such cases, our liability will be limited to the fees that you have paid towards our services.
You agree to indemnify and hold harmless Skyrecs Technologies, its officers, directors, and employees, from and against any losses and damages arising out of or relating to any claims that you have used the Services in violation of another party's rights as per the terms in this Agreement.
We may modify the Terms from time to time. We will notify you of any such modifications to our terms of service. If you do not accept the modified terms of service, you may choose to discontinue with our services. If you choose to continue using our services, then you are explicitly agreeing to our new, modified terms of service.
Your use of this website and any dispute arising out of such shall be governed by and construed in accordance with the laws of the INDIA.
